Terms and conditions
All bookings made by telephone, fax, e-mail or via your travel agent imply unreserved acceptance of these terms and conditions.
ARTICLE 1 PRICE
All prices are per person (unless otherwise stated in the price tables). Prices include
Travel in various types of vehicle
VAT at the rate applicable on January 1, 2013
Prices do not include
Cancellation/assistance/luggage insurance premium.
ARTICLE 2: DISCOUNT
All children's discounts shown in the price tables apply only to children under 10 accompanied by at least 1 adult.
ARTICLE 3: SURCHARGES
Any supplements shown in the price tables apply per person and for the period indicated, unless otherwise stated in the price tables. Gratuities are not compulsory; any gesture of appreciation to staff is left entirely to the discretion of our customers.
ARTICLE 4: TERMS OF PAYMENT
The invoice is payable in full in cash to the head office of HG Travel-Autos sprl 484, chaussée de Mons 7810 Maffle either by bank transfer to the account of HG Travel-Autos sprl 30 days before your departure or by credit card subject to a surcharge of 2% (please advise when booking) and as a last resort to pay the transfers to the driver on the outward journey.
Any delay in payment will automatically and without formal notice result in the application of late payment interest equal to the interest stipulated in the law of August 2, 2002, and the payment of a fixed indemnity of 20% of the outstanding balance, with a minimum of € 50.00 and a maximum of € 500.00. Failure to pay an invoice when due, or to comply with any of the clauses of the present contract, authorizes HG Travel-Autos to terminate the present contract immediately and by operation of law, to the detriment of the customer.
No dispute will be accepted by HG Travel-Autos sprl more than 2 months after the invoice has been issued. If the invoice has not been contested within this period, the amount will be deemed to be due in its entirety without any further recourse, unless the customer proves that it was impossible to receive the invoice (or certified copies).
ARTICLE 5: LUGGAGE
Luggage is limited to one suitcase of max. 20kg and one bag of max. 5kg per person. We accept no liability for loss, theft or damage to luggage and/or its contents. We therefore advise you to take out an insurance policy.
ARTICLE 6 TRAVEL FORMALITIES
It is the responsibility of the non-Belgian traveler to check personally with the relevant authorities for the documents required for travel (identity card, valid passport, visa, vaccination certificate, etc.). The information given on this subject in any brochures is for guidance only. Children unaccompanied by the head of the family or guardian must be in possession of a legalized certificate authorizing them to travel.
ARTICLE 7: ANIMALS
Small dogs (under 5kg) are tolerated on board the vehicles at the rate of one per vehicle (subject to a suitable cage provided by the customer and a supplement of €5). The dog owner must obtain the agreement of HG Travel-Autos sprl and the final transport company, and must comply with the legislation of each destination or transit country.
ARTICLE 8: SCHEDULE AND ITINERARY
Timetables are based on normal traffic conditions and are given as an indication only. However, unforeseen circumstances may occur, for which HG sprl Travel-Autos cannot be held responsible. The choice of itinerary must be left to the carrier, unless the client explicitly specifies a particular requirement, and is entirely his own responsibility. It is the carrier's responsibility to inform the client before the start of the service.
ARTICLE 9: CARRIER'S LIABILITY
HG Travel-Autos sprl is responsible for the proper execution of its obligations resulting from the assumption of responsibility for a transfer. However, HG Travel-Autos sprl cannot be held responsible for the poor execution of a transfer due to the fault of a customer for any reason whatsoever, the travel agency, an unforeseeable and insurmountable event following a technical failure, or due to bad weather conditions, possible traffic jams or other cases of force majeure. HG Travel-Autos sprl cannot, under any circumstances, be held responsible for the possible consequences of strikes or social unrest that we may encounter during the performance of our work. Any unnecessary displacement of our drivers will be invoiced to the customer.
ARTICLE 10: MODIFICATIONS AND CANCELLATIONS BY THE CUSTOMER
To be taken into account, all modifications must be confirmed to us by fax, e-mail or post at least 8 days before departure. However, if these modifications result in an additional cost, the carrier will apply this supplement on the same basis as the initial calculation.
In the event of cancellation by the customer, and unless otherwise stated on the contract, the following cancellation charges will apply:
Up to 1 month before departure: 50%, less than 1 month before departure: 75%, with a minimum of €30 per booking.
ARTICLE 11: MODIFICATION OF THE CONTRACT DURING THE TERM OF THE CONTRACT
Delays in transport times due to unforeseen traffic difficulties do not entitle the customer to any compensation. The customer may always request a modification of the contract during the course of the contract, but the carrier, represented by his driver, is not obliged to accept. If the carrier accepts such a modification, it must be carried out in compliance with the regulations. Any modification of the itinerary by the customer or passenger is his/her responsibility and will result in a modification of the contract. Any change to the contract may result in a change to the fare conditions. Any request for modification to the contract, whether made by the customer or the carrier, must be confirmed in writing or by any other method that allows it to be memorized.
ARTICLE 12: SAFETY ON BOARD
Seat belts must be worn. Baby seats and booster seats will be provided for the safety and comfort of your children (please specify at the time of booking). Passengers must refrain from soiling or damaging the equipment. Passengers will be billed for any damage to the vehicle other than normal wear and tear. We cannot be held responsible if personal belongings are forgotten in the vehicle.
ARTICLE 13: PERMANENCE
In case of emergency, and only in this case, a hotline is available outside office hours, 7 days a week. Call +32(0)476/70.51.57 , who can either answer directly or read urgent messages. This free service cannot be held responsible for technical failures or temporary unavailability, nor does it guarantee an immediate response.
ARTICLE 14: JURISDICTION
Any dispute will be brought before the courts of Tournai.
